- Technical usage data when applying through our systems, e.g. login, device, access and log data.
Purposes of Processing
3.1Conducting the Application and Selection Process
We process your personal data for the purpose of taking steps prior to entering into an employment relationship and conducting the application and selection process. This includes in particular:
- Receiving, assigning and processing your application;
- Assessing your qualifications and suitability for the advertised position or a position specified by you;
- Communicating with you and planning and conducting interviews and selection appointments;
- Involving the specialist departments, managers and, where applicable, employee representative bodies participating in the selection process;
- Preparing a hiring decision and, where applicable, drawing up an employment contract;
- Documenting the application process, ensuring IT and information security, and establishing, exercising or defending legal claims.
3.2Legal Bases for Data Processing
Your personal data is processed on the basis of the following provisions:
a)Conducting the application process
Article 6(1)(b) GDPR in conjunction with Section 26(1) of the German Federal Data Protection Act (BDSG), where applicable, or the relevant provisions of employment data protection law.
The processing is carried out in order to take steps at your request prior to entering into a contract and to decide whether to establish an employment relationship.
b)Compliance with legal obligations
Article 6(1)(c) GDPR, insofar as the processing is necessary for compliance with legal obligations.
c)Protection of legitimate interests
Article 6(1)(f) GDPR, in particular for the establishment, exercise or defence of legal claims and to ensure the security of our IT systems, provided that the statutory requirements are met.
d)Consent
Article 6(1)(a) GDPR, where applicable in conjunction with Article 9(2)(a) GDPR.
This applies in particular to voluntary inclusion in an applicant pool or other additional processing that is not necessary for conducting the specific application process, in particular the further disclosure of applicant data within the group of companies.
You may withdraw any consent you have given at any time with effect for the future. The lawfulness of processing carried out before the withdrawal remains unaffected.
3.5Special Categories of Personal Data
Where you provide us with special categories of personal data within the meaning of Article 9(1) GDPR, or where their processing is exceptionally necessary, such processing will take place only on an applicable legal basis, in particular pursuant to Article 9(2) GDPR in conjunction with Section 26(3) BDSG, or on the basis of your explicit consent.
Recipients or Categories of Recipients
Within our company, your personal data will be made accessible only to those persons and departments that require it to conduct the application process.
This includes in particular:
- The responsible Human Resources department;
- Managers and employees of the specialist departments involved;
- Where applicable, the responsible employee representative bodies within the scope of their statutory duties;
- Internal IT and administrative departments, insofar as this is necessary for technical implementation.
Where necessary, we use external service providers, in particular providers of applicant management systems, IT services and communication platforms.
Where these service providers process personal data on our behalf, this is carried out on the basis of corresponding data processing agreements pursuant to Article 28 GDPR.
Data will be disclosed to other companies within our group only where there is an appropriate legal basis and the disclosure is necessary for the respective purpose.
As a rule, your data will not otherwise be disclosed to third parties unless this is required by law or otherwise legally permissible.
Use of Digital Applicant Management Systems and AI-Supported Applications
We may use digital applicant management systems to organize and conduct our application procedures.
Where corresponding functions are actually used, AI-supported applications may also be used for administrative support, for example to structure, prepare or summarize application documents.
Any such use will take place exclusively in compliance with the applicable data protection requirements.
Where AI systems are used to assess or preselect applications, we will inform you separately about their specific functionality and the associated data processing, insofar as required by law.
No decision based solely on automated processing that produces legal effects concerning you or similarly significantly affects you will be made unless we expressly inform you of legally permissible processing to the contrary.
The hiring decision is made by the persons responsible for this purpose.
Transfer of Personal Data to Third Countries
Personal data may be processed outside the European Union or the European Economic Area (EEA), in particular in connection with the use of international IT service providers or cooperation within the group of companies.
Where such a transfer takes place, we ensure that the statutory requirements of Articles 44 et seq. GDPR are met.
This may be achieved in particular through an adequacy decision by the European Commission pursuant to Article 45 GDPR or appropriate safeguards pursuant to Article 46 GDPR, especially the conclusion of EU Standard Contractual Clauses.
Where necessary, supplementary technical and organizational safeguards will be implemented.
You may request information about the safeguards used in individual cases and the option of obtaining or inspecting a copy using the contact details provided in Section 2.
Retention Period
As a rule, we retain your personal data only for as long as necessary to conduct the application process and comply with legal obligations.
In the event of a successful application, the personal data required for the employment relationship will be transferred to the personnel file and processed in accordance with the applicable data protection provisions.
In the event of an unsuccessful application, your personal data will generally be deleted no later than six months after completion of the application process, unless statutory retention obligations or other legitimate reasons require longer retention.
Longer retention may be necessary in particular where specific legal claims are asserted or corresponding proceedings are pending.
Applicant pool: If you have expressly consented to the inclusion of your application documents in our applicant pool, we will retain your data for a period of 12 months from the date on which consent was given, unless you withdraw your consent earlier.
At the end of the respective retention period, your personal data will be deleted or anonymized unless statutory obligations prevent this.
Your Data Protection Rights
Where the statutory requirements are met, you have the following rights in particular:
- Right of access pursuant to Article 15 GDPR;
- Right to rectification pursuant to Article 16 GDPR;
- Right to erasure pursuant to Article 17 GDPR;
- Right to restriction of processing pursuant to Article 18 GDPR;
- Right to data portability pursuant to Article 20 GDPR;
- Right to object pursuant to Article 21 GDPR;
- Right to withdraw consent with effect for the future;
- Right to lodge a complaint with a data protection supervisory authority pursuant to Article 77 GDPR.
The statutory restrictions, in particular those under Sections 34 and 35 BDSG, may apply to rights of access and erasure. Please send requests, preferably in writing, to the contact details specified in Section 1 or directly to the Data Protection Officer.
Provision of Personal Data
The provision of your personal data is generally neither required by law nor by contract.
However, the provision of certain information is necessary so that we can assess your application and decide whether to establish an employment relationship.
Without the information required for this purpose, it may not be possible to conduct the application process properly.
Collection of Personal Data from Third Parties
As a rule, we collect your personal data directly from you.
In certain cases, we may also receive personal data from third parties, for example from recruitment agencies, professional networks or employee referrals, provided that this is legally permissible.
In such cases, we will inform you pursuant to Article 14 GDPR about the categories of personal data received, their source and the respective purposes of processing, unless a statutory exception to the information obligation applies.
Independent research concerning applicants in publicly accessible sources will be carried out only insofar as this is necessary and legally permissible for the specific recruitment process.
Automated Decision-Making
We do not use decision-making based solely on automated processing, including profiling, within the meaning of Article 22 GDPR. Should we use such a procedure in individual cases in the future, we will inform you separately, insofar as required by law.
Information About Your Right to Object Pursuant to Article 21 GDPR
You have the right, on grounds relating to your particular situation, to object at any time to the processing of your personal data where such processing is based on Article 6(1)(e) or (f) GDPR. This also applies to profiling based on those provisions.
If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.
The objection may be made in any form and should preferably be addressed to Human Resources or the Data Protection Officer using the contact details specified in Section 1.
